These terms are the agreement between you and Postbud (“Postbud”, “we”) for using postbud.email, the Postbud dashboard, API and WordPress plugin (the “Service”). By creating an account or using the Service you accept them. If you accept on behalf of a company, you confirm you may bind it, and “you” means that company.
1. Your account
- You must be at least 18 and use the Service for your business, organization or professional activity.
- Give accurate details and keep your password and API keys safe. You are responsible for what happens under your account, including by team members you invite.
- One Free plan account per person or business. Creating several accounts to stack free allowances is not allowed.
- Tell us at info@postbud.email if you suspect unauthorised access.
2. Plans and payment
- Free plan. New accounts start on the Free plan, which costs nothing and needs no card. It has lower limits (shown on the pricing page). There is no time-limited trial of the paid plans. We may change or end the Free plan with 30 days' notice.
- Plans. Plans are priced per month in euros and limit how many emails you can send each month (plus other limits shown on the pricing page). Paid plans have no limit on stored subscribers. When you reach a limit, further sending is refused until the next month or until you upgrade.
- Payment. Paid plans are charged by card through Stripe on the day you choose one, then monthly in advance on that date, and renew automatically until cancelled. Prices exclude any VAT or similar tax that applies, which is added where required.
- Changing plans. Upgrades and downgrades are prorated for the rest of the billing month.
- Failed payments. If a payment fails, Stripe retries it. While it stays unpaid, we may stop sending or suspend the account until it is paid.
- Price changes. We will email you at least 30 days before a price change affects your plan. If you do not agree, you can cancel before it takes effect.
- Refunds. Fees already paid are not refunded, including for a partly used month, except where we end the Service without cause on your side (we then refund the unused part) or where the law requires it.
3. Cancelling and deleting
- You can cancel any time under Settings → Billing. The plan stays active until the end of the period you paid for and is not renewed. After that the account moves to the Free plan and its limits apply.
- After cancellation your data stays in the account so you can come back. To have the account and all its data deleted, email us from the account's address; we delete it within 30 days, except records we must keep by law (such as invoices).
- You can export your subscribers from the dashboard at any time, including before you leave.
4. Acceptable use and anti-spam rules
Postbud only works if inbox providers trust the email it sends. These rules protect every customer's delivery, so we enforce them.
You may only email people who agreed to hear from you
- Every address you send marketing to must have given you permission, or be an existing customer where the law allows that, and you must be able to show how and when you got it.
- Do not use bought, rented, scraped, shared or harvested lists, and do not email addresses you got for a different purpose.
- Do not remove or hide the unsubscribe link or sender details Postbud adds, and do not re-add people who unsubscribed, bounced or complained.
- Use honest sender names and subject lines that match the content.
You may not use the Service to send or host
- anything illegal, or that infringes someone else's rights (copyright, trademarks, privacy);
- phishing, malware, scams, deceptive offers or pyramid schemes;
- content that harasses, threatens or promotes violence or hatred against people;
- sexually explicit content, or content involving minors in any sexual way;
- gambling, adult services, illegal drugs, weapons, cryptocurrency or investment “opportunities”, debt relief, or other categories with high complaint rates, unless we have agreed to it in writing;
- anything that tries to break, overload, probe or get around the limits or security of the Service.
How we enforce this
- New sending domains are warmed up gradually, and a campaign pauses itself if bounces reach 5% or spam complaints reach 1% (after 100 sends).
- We may review accounts, campaigns and lists when there are signs of abuse or after a complaint, and may pause sending, remove content, or suspend or close an account that breaks these rules, where possible after contacting you first. Serious or repeated breaches can lead to immediate suspension without refund.
5. Your content and your contacts' data
- You keep all rights to your content (emails, templates, images, lists). You give us permission to store, copy, process and send it only as needed to provide the Service to you.
- You are responsible for your content and for having a lawful basis to collect and email your contacts, and for your own privacy notice to them. For your contacts' personal data you are the controller and we are your processor; the data processing terms below apply.
- If someone makes a claim against us because of your content, your lists or your breach of these terms, you will cover our reasonable costs and any damages that result.
6. The Service
- We keep improving Postbud and may change, add or remove features. We will give reasonable notice before removing something important you rely on.
- We work to keep the Service available, but we do not promise it will be uninterrupted or error-free. Maintenance, provider outages and other problems can happen.
- Nobody controls inbox placement. We do not guarantee that any email is delivered, lands in the inbox rather than spam, or is opened.
- Integrations with other services (WordPress, WooCommerce, Zapier, Stripe and others) depend on those services; we are not responsible for them.
- Postbud, its software, design and brand belong to us. These terms do not give you rights to them beyond using the Service.
7. Liability
- The Service is provided “as is”. To the extent the law allows, we give no other warranties, for example of fitness for a particular purpose.
- We are not liable for indirect or consequential losses, such as lost profit, revenue, data or goodwill, or for losses caused by your content, your lists, third-party services or events outside our reasonable control.
- Our total liability for all claims in any 12 months is limited to the fees you paid us in those 12 months.
- Nothing in these terms limits liability that cannot be limited by law, such as for intent or gross negligence, or rights a consumer has under mandatory law.
8. Suspension and termination
We may suspend or close your account if you break these terms, do not pay, or if your use puts the Service, other customers or our sending reputation at risk. We may also stop offering the Service with at least 30 days' notice, refunding any prepaid unused period. Sections 5 (responsibility for your content), 7 and 10 continue to apply after termination.
9. Changes to these terms
We may update these terms. For changes that matter to you, we will email you at least 30 days in advance. If you keep using the Service after the change takes effect, the new terms apply; if you do not agree, you can cancel before then.
10. Law and disputes
These terms are governed by the law of the country in which the operator of Postbud is established. Disputes go to the competent courts at the operator’s registered seat, unless mandatory law gives you the right to bring them elsewhere. Before going to court, please write to us; most problems are solved faster that way.
Postbud. Email: info@postbud.email. How we handle personal data is described in the Privacy Policy.
Annex: Data processing terms
This annex forms part of the terms and applies when we process personal data for you as your processor (GDPR article 28, and the equivalent Serbian law on personal data protection).
Subject matter and duration
Providing the Service: storing your contacts, sending your emails, tracking opens, clicks and unsubscribes, and running your forms, landing pages, automations and integrations, for as long as your account exists.
Data and people concerned
Your contacts (subscribers, customers, leads) and your team members. Data: email address, name, tags and custom fields you add, consent records, email activity (sends, opens, clicks, bounces, unsubscribes) and, if you connect a store, purchase and product-view data. You must not upload special categories of data (such as health, religion or sexual orientation) or data about children.
Our commitments
- We process the data only on your documented instructions, which are these terms and your use of the Service, unless the law requires otherwise (we will tell you if we can).
- Everyone we allow to access the data is bound by confidentiality.
- We apply appropriate technical and organisational security measures, as described in the Privacy Policy.
- We use the sub-processors listed in the Privacy Policy, under written terms that protect the data as this annex does. We will announce new sub-processors by updating that list and, for material changes, by email; you may object, and if we cannot resolve the objection you may cancel.
- Transfers outside the EEA rely on the safeguards described in the Privacy Policy.
- We help you, as far as reasonably possible, to answer your contacts' requests to exercise their rights, and with security, breach notification and impact assessments.
- We notify you of a personal data breach affecting your data without undue delay after becoming aware of it.
- When the account is deleted, we delete the data (after letting you export it), except where the law requires us to keep it.
- We make available the information needed to show we meet these obligations, and answer reasonable audit questions in writing.
Your commitments
- You have a lawful basis for the data and the emails, give your contacts the information the law requires, and keep your instructions lawful.
